GENERAL TERMS AND CONDITIONS OF SALE

  1. Identity of the seller

This e-commerce site is operated by Marini Giuseppe e Figli S.S. Agricola, with registered office at Via Bartolomeo Sestini 274 – 51100 Pistoia (Italy), VAT No.: IT01876600477, email: info@marinifarm.it  telephone: +39 0573 451162.

  1. Definitions

For the purposes of these Terms and Conditions:

1.“Company” or “Seller”: refers to Marini Giuseppe e Figli S.S. Agricola, the company that sells products from its range via the Internet (by email or through its website) based on its production.

2.“Marini Giuseppe”: refers to the brand affixed to  the Products owned by the Company.

3.“Customer”: is the purchaser of the Products who has the status of a consumer, meaning a natural person acting for purposes unrelated to any business, commercial, craft or professional activity they may carry out.

4.“Consumer Code”: refers to the provisions set out in Legislative Decree No. 206 of 6 September 2005.

5.“General Terms and Conditions”: refers to these General Terms and Conditions for the online sale of consumer goods.

6.“E-commerce”: the set of activities involving the sale and purchase of products carried out via the Internet.

7.“Force Majeure”: refers to any series of extraordinary and unforeseeable events that prevent or make the proper performance of the contract extremely difficult. Cases of Force Majeure include, by way of example and without limitation, measures taken by public authorities, strikes by the carriers used by the Company, and any other circumstance beyond the Company’s control, including all delivery delays not directly attributable to the Company itself.

8.“Islands”: refers to the regions of Sicily and Sardinia and their respective archipelagos.

9.“Promotions”: sales organised by the Company for all or some of the Products, or for limited periods, offering an exceptional discount on the retail price.

10.“Products” / “Product”: all consumer goods and/or merchandise produced and marketed by the Company and forming part of its product range.

11.“Product Description”: indicates the essential characteristics of each Marini Giuseppe-branded Product.

12.“Service(s)”: indicates the online sale of Marini Giuseppe-branded food products owned by the Company.

13.“Website”: the collection of web pages accessible via the address www.marinifarm.it through which the Services are offered.

14.“Voucher”: vouchers for visits and tastings that can be purchased via email.

15.“Order”: a contractual proposal sent by the Customer via the website or email.

16.“Order Confirmation”: a notification confirming the conclusion of the sales contract.

  1. Scope of Application

These terms and conditions govern the distance selling of products offered via the e-commerce website and via remote communication (e.g. email).

By placing an order, the Customer fully accepts these terms and conditions.

  1. Nature and conclusion of the contract

The sales contract is deemed to have been concluded:

  • in the case of online purchases, upon confirmation of the order
  • in the case of purchases made via email, upon receipt of the customer’s written confirmation
  1. Products

The products sold are:

  • wines
  • Vin Santo
  • olive oil
  • spirits
  • related items

The images published on the company website are for illustrative purposes only and may differ from the actual product.

Product availability is indicative and may vary. In the event of unavailability, the Customer will be informed and refunded.

  1. Sale of alcoholic beverages

The sale of alcoholic beverages is restricted to those aged 18 and over.

By placing an order, the Customer declares that they are of legal age.

The Seller reserves the right to request age verification, including via the courier.

  1. Prices

All prices are quoted in Euros (€) and include VAT, unless otherwise stated.

The Seller reserves the right to cancel orders in the event of obvious pricing errors.

Delivery charges are shown before the order is finalised.

For international shipments, any duties or taxes are payable by the customer.

  1. Discounts and promotions

The Seller may apply discounts, vouchers or promotions to the products sold, in accordance with the terms and conditions specified at the time of the offer.

Discounts:

  • are valid only for the products and quantities specified in the promotion
  • cannot be combined unless otherwise stated
  • may be subject to time limits or expiry dates
  • may be revoked in the event of obvious errors in their communication

The final price of the order, including any discounts applied, will be that indicated at the time of order confirmation.

  1. Purchase methods (e-commerce)

The Customer selects the products and completes the procedure online.

The order is binding upon acceptance of these Terms and Conditions.

  1. Sales via email

In the case of purchases via email:

  • the Seller’s communication constitutes an offer
  • the Customer’s reply constitutes acceptance

The contract is deemed concluded upon receipt of the Customer’s confirmation.

These terms and conditions also apply in such cases.

  1. Payments

Payments may be made using the methods indicated on the website or as agreed via email.

  1. Shipping and delivery

Shipments are made via courier within Italy and abroad.

Delivery times are approximate (on average 2 to 5 working days).

Upon delivery, the Customer must check:

  • that the packaging is intact
  • any damage

Any issues must be reported to the courier and notified to the Seller within 24 hours by email to: info@marinifarm.it.

  1. Liability

The Seller shall not be liable for delays due to force majeure. In any event, the Consumer’s rights under the law remain unaffected.

  1. Right of withdrawal

The Customer has the right to withdraw from the contract within 14 days of delivery, without having to give any reason.

To exercise this right, the Customer must send an email to: info@marinifarm.it

The products must be returned:

  • undamaged
  • unused
  • in their original packaging

Return postage costs are to be borne by the Customer.

The Seller shall refund all payments received (including standard delivery costs) within 14 days of receiving the returned goods, using the same payment method chosen by the Customer at the time of purchase, unless the Customer has expressly agreed otherwise.

  1. Complaints

Any complaints must be reported within 24 hours of delivery by email to:  info@marinifarm.it

The 24-month statutory guarantee of conformity  provided for by law remains unaffected.

  1. Tour and tasting vouchers

Vouchers can also be purchased via email.

Terms and conditions:

  • Validity: 12 months
  • Booking required
  • Non-refundable if the voucher specifies a date; otherwise, they may be cancelled and refunded within 3 days
  • In the event of a no-show, the voucher is considered used
  1. Cancellation policy for tours and tastings

For vouchers relating to tours and tastings:

  • You may cancel or reschedule your booking at least 3 days prior to the scheduled date by sending an email to info@marinifarm.it
  • In the event of cancellation after the specified deadline or a no-show, the voucher is considered used and no refund will be given
  • Any exceptions (e.g. force majeure) will be assessed on a case-by-case basis by the Seller
  1. Privacy

Personal data is processed in accordance with the Privacy Policy available on the website, in compliance with the GDPR.

  1. Dispute resolution

The European Commission provides an online dispute resolution (ODR) platform, accessible via the following link:

  1. Governing law

The contract is governed by Italian law.

  1. Jurisdiction

For Consumers, the court of the place of residence or domicile shall have jurisdiction.

  1. Acceptance of the terms and conditions

Before completing the online order, the Customer is required to accept these terms and conditions by ticking the relevant checkbox.

In the case of sales via email, written confirmation of the order constitutes acceptance of these terms and conditions.

  1. Changes to the Terms and Conditions

The Seller reserves the right to amend or update these Terms and Conditions at any time.

Any changes will take effect immediately upon publication on the website and will apply to orders placed after that date.

For orders already completed, the terms and conditions accepted at the time of purchase remain valid.

  1. Differences in language interpretation

In the event of any discrepancies or conflicts between the Italian and English versions of these Terms and Conditions, the Italian version shall prevail.
